Accusing Illegal Acts

Impeaches cases to be handled by the Department:

 

1. Unlawfully asking for bribe when performing duties

2. Obstructing to ask for benefits

3. Infringing others’ rights and breaking laws or regulations

4. Asking commission for public works or purchase

5. Asking for a favor by dignitary

6. Illegal bidding, limited bidding, and revelation of price floor

7. To accept gifts or reception from the public or contractor

8. Lavishness, squander or deterioration

9. To scamp work and stint material, or to inspect inappropriately

10.  Other corruption affairs

Award measures for encouraging whistleblowing of corruption

According to the “Methods of Awarding and Protecting Whistleblowing of Corruption”, the government will, dependent on the sentence of the court, grant a reward to the person who impeaches the corruption if the corruption is judged guilty. The amount of the award is between min. 300 thousand and max. 10 million NT dollars. The standard is as follows:

Imprisonment for more than 7 years but less than 10 years

Imprisonment for more than 5 years but less than 7 years

Imprisonment for more than 3 years but less than 5 years

Imprisonment for more than 1 year but less than 3 years

Imprisonment for less than 1 year, penal labor, or fine

 

Amount of award

More than NT $ 6.7 million to less than NT $ 10 million

More than NT $ 4 million to less than NT $ 6.7 million

More than NT $ 2.8 million to less than NT $ 4 million

More than NT $ 2 million to less than NT $ 2.8 million

More than NT $ 1.4 million to less than NT $ 2 million

More than NT $ 800 thousand to less than NT $ 1.4 million

More than NT $ 300 thousand to less than NT $ 800 thousand

 

One third of the award shall be granted after the defendant was judged guilty in the first trial. The rest award shall be granted after the defendant was finally judged guilty by the court. Except that the person who impeaches the corruption makes a false charge, the granted awards shall not be taken back by the government. 

Protection measures for encouraging whistleblowing of corruption

According to the above Methods, the agency that accepts and handles the whistleblowing shall keep secret the name, age, and address of the person who impeaches the corruption. Unless it is absolutely necessary, the whistleblowing documents, written records, and other material of the person who impeaches the corruption shall be kept separately and not attached in the inspection files. The person who discloses these secrecy shall be punished in accordance with Criminal Law or other related laws.
